Yeah how serious was the fight? Shoplifting and scuffle does not warrant the death penalty.
I wish people would stop saying "X doesn't warrant the death penalty."
The death penalty is a sentence handed down through the judicial system. There's a process which goes along with that, and that process doesn't apply to 99% of the situations where that phrase is used, this one included.
I get the analogy you're trying to make. It's just a terrible analogy. It's very bumper-stickery.
He apparently came in the store with a gun. Unlimited open carry is legal for anyone in Texas who owns a gun since the Texas Legislature screwed up in September of 2021.
This is why store employees are told not to fight or get in the way of someone stealing. It does not work out in anyone's favor not involved in the theft including bystanders.
Society cannot survive the advice to simply allow criminals to do as they please, without resistance or consequence. That’s a recipe for lawlessness, for which no one is safe.
Furthermore, when a perpetrator engages in violence against innocents, you do not need to measure your response, or carefully match the level of force against you. You use overwhelming force to eliminate the threat.
And for those so caught up in this idiocy of claiming the criminal was “unarmed”, I say you are wrong … the criminal had two arms, which makes him fully armed, and the consequence he suffered, he brought upon himself.
What many seem to not understand is that a person can kill you, or cause you severe bodily harm, with nothing more than their bare hands. A stout male of sufficient strength can snap the neck of a female with relative ease, or deliver a death blow to an equal male, by striking him in the throat-larynx region, instantly crushing their airway, taking away their ability to breathe, as they collapse to the ground and die in 120 seconds.
So, people need to stop defending criminals, and calling for the punishment of those who confront and stop them. The Good Samaritan who took action, might easily be the next guy who decides not to take action against a criminal that kills your grandma for the $20 in her purse.

That really is the point, isn’t it? Nobody knows the intentions of a stranger. But when such a stranger is already in the process of committing a crime, we at least know at that point, he is a criminal, don’t we? And, at that point, we have no way of determining to how far he is willing to go, but we must assume the worst case scenario, as opposed to offering the benefit of doubt.
Doubt involves hesitation, and hesitation can be deadly, when dealing with criminals
