Also, the asylum law has been around forever. Only last 3 years we have seen an uptick and record-breaking in illegal immigration at the southern border
So, is there a problem with the current immigration law?
or is that because that old guy in the White House isn’t doing his job? You tell us
If you don’t like the current asylum laws, then work on changing the laws instead of grandstanding for political benefit. Passing legislation requires compromise, which unfortunately among R’s now is tantamount to treason.
The Democrats do not want to change our asylum laws so they won't pass any legislation that does that. Compromise? The price is too high for the kind of compromise that the Democrats want. Why don't they just agree that our asylum laws are being abused and just make that not possible anymore but noooooooo it doesn't fit their agenda
As a Texan, I am prepared to enforce this law, then when the feds push to end it, to defy the feds. Utterly and completely.
Then when the feds send in the feds to arrest Texas politicians enforcing the law, to arrest the feds and charge them with obstruction and attempted kidnapping.
I'm literally at the point where it is time to defy all things DC. Utterly and completely and with the force of State Law.
^^^^this right here. It's really gotten to this point.
Show me where it says a state TX LEO can arrest an illegal alien based on “suspicion”
An arrest is based on “probable cause” for any crime committed
"when there is a reasonable basis for believing that a crime may have been committed"
Counters what a lot of our posters, like you, have been claiming, doesn't it? "Definition
Probable cause is a requirement found in the Fourth Amendment that must usually be met before police make an arrest, conduct a search, or receive a warrant. Courts usually find probable cause when there is a reasonable basis for believing that a crime may have been committed (for an arrest) or when evidence of the crime is present in the place to be searched (for a search). Under exigent circumstances, probable cause can also justify a warrantless search or seizure. Persons arrested without a warrant are required to be brought before a competent authority shortly after the arrest for a prompt judicial determination of probable cause. Overview
Constitutional Basis
Although the Fourth Amendment states that "no warrants shall issue, but upon probable cause", it does not specify what "probable cause" actually means. The Supreme Court has attempted to clarify the meaning of the term on several occasions, while recognizing that probable cause is a concept that is imprecise, fluid and very dependent on context. In Illinois v. Gates, the Court favored a flexible approach, viewing probable cause as a "practical, non-technical" standard that calls upon the "factual and practical considerations of everyday life on which reasonable and prudent men [...] act".1 Courts often adopt a broader, more flexible view of probable cause when the alleged offenses are serious."
When the federal government is aiding and abetting criminals? Anyone with even a marginal ability to think logically knows the answer to the OP. The federal government is now an organized crime ring. Of course the states have a right to enforce the law, even if it is the federal government largely responsible for the criminal activity.
Texas LEOs still have probable cause to enforce a law (state or federal law) if they are witnessing the crime taking place. This is why the new law in TX allows state LEO to arrest an alien illegal, with probable cause, if they see that alien is illegally crossing between two countries.
It’s like saying an FBI or ATF agent cannot detain and arrest a shoplifter in Texas because there is no “shoplifting” code under United States Codes
That may fall under public safety - they can hold but not arrests- sure can’t. Just like an agent can’t pull you over for speeding. If there is public safety in question, they may respond to stop until locals come.
As much as some would like - we are not a police state or operate like “La Guardia ” say in Mexico.
