I don't know. But, given the statement in the report, he willfully retained classified documents from as far back as his time in the senate during the seventies, and is not being charged solely because he's not mentally-competent enough to stand trial.

The sad thing about all of this, as the report states, the likelihood of President Biden remembering that he's going to give this speech by tomorrow morning is slim to none... And half the country will still vote for this...

I was out working on my truck and came in to reports on many US, and all foreign news sources that the DOJ stated the president committed crimes of national security, but is not competent to stand trial.
