If they are found guilty maybe we can ship all those who want to give them your rights to gitmo so you can be with them.
HELLO????????? MOD CUT there are INNOCENT people that have been locked up in there for years. No rights, NONE, no communication w/family, friends. Yeah, I'll set you in that situation & see how well you acclimate to that. And I haven't made it a dem/rep issue at all, again did you read my post??? This has to do w/innocent people getting thrown in prison because our lovely administration (yep this is where I insert politics) looked at their name or the color of their skin & made an assumption. That is unacceptable.

Gee, wonder why all these wing nuts are crawling out from a rock without any faith in justice system. They're either guilty or not guilty PERIOD. If you're afraid they're innocent, I'd say you have right to be afraid now because of the way you've denied our own laws to work.
Instead, you signed off on being a facist nation, override democracy the first chance you got for a false sense of security, use the constitution for toilet paper just like your hero Bush. Lying to yourselves only makes you a fool longer than you ever had to be.

You fail to see the difference between war and a speeding ticket. Do really want our soldiers to be in the middle of the battlefield, taping off a section to take pictures, fingerprints, and pick up spent rounds to match DNA with the guy that he just captured? There has been a long history of military tribunals for this purpose.

What the convention calls for is tribunals as you previously stated. Our courts blocked our tirbunals and granted access to civilian courts which IMO is the wrong decision.
Our civilian courts determined that the tribunals were going to be kangaroo courts. The lead military prosecutor resigned in disgust and is now appearing for the defense. The senior military convening officer has been removed for tampering with the legal process.

Regardless of that, these prisoners are required to be treated as POWs until a legal determination has been affirmed that they are not covered POWs. It hasn't ever happened. And they haven't ever been afforded those protections.

No just treat those captured as POWS.

I have no problems with them having tribunals. If the tribunals were going to be kangaroo courts, then there should be standards and oversight. I don't think they should be a joke. I do think that bringing them into civilian courts is a mistake.

I will admit ignorance of exactly where the breakdown occurred. Was it a problem with the military's process, or did the politicians get involved?

The prisoners at Guantanamo have very few rights.
They are not enlisted uniformed combatants engaged in lawful conduct of warfare.
They are not protected under the Geneva Conventions or any other regulation governing the conduct of warfare.
What they are is terrorists, criminals of the lowest order and basically the military can try, convict and punish them as necessary.
