I'm glad that the court is going to review it. No matter what happens, I hope that the way California has this proposition process set up is revised. Propositions that have sweeping consequences like this should require a 2/3 passing vote. Also, as a friend of mine pointed out, the majority should never have the power to make decisions for a minority like this.

In the 1960s, the people of California voted to repeal fair housing laws, meaning that it would again be legal to discriminate against people based on the color of their skin. The California Supreme Court ruled that it was unconstitutional and it was overturned.
It's happened in other cases. It's not unprecedented for a court to overturn a vote like this, particularly since it deals with what they called a "basic civil right" this past May.
It is a fundamental human right. Gays in CA are a protected class and are subject to the same rights and responsibilities as all others. We should not have to be arguing over who is worthy of marriage in this country. All should be entitled to these rights.

I think its a shame that the amendment passed, but that's our fundamental right. I'm anxiously awaiting the outcome of this one.
You're right, what is the point? However, this referendum never should've been put on the ballot, having to do w/civil rights instead of say building a new stadium w/tax payer money.

Also: What's the point of having a Supreme Court or judiciary branch if the popular vote is the final word?
We could draw it out even further and ask: Why even have a legislative branch? Just let the people vote and we'll have majority rule on everything.

It's curious that the Supreme Court let it go through anyway when the No on 8 side argued that it should not be placed back on the ballot back in July. Maybe they had more faith in CA voters that the Prop would fail? A lot of us had more faith in our fellow citizens, i suppose.

I know, I didn't understand that one either. God, that was such a great day too, I was so happy for everyone. And then....it was BS pure & simple & I don't understand how they bent to the puritans.
