If someone feels they are male when they have a female body or female with a male body, they can change their sex by surgery, hormones, etc.

They are already feeling that they ARE that other sex. That's all that matters, IMO. It doesn't need to be so "technical" as you're proposing.

I wonder in California, if a girl is married to a guy who has a sex change to a woman, would this make it a lesbian relationship and annul the marriage under Prop 8.
I also wonder why anyone outside of that relationship would think it's any of their business.
