How right you are. Under the UCMJ there are administrative procedures to challenge the authority of a commanding officer. Under SCOTUS rules you cannot file a case in the federal court system until you have exhausted all administrative procedures available to you. None of the active duty peoplle or members of the reserve have done this.
It seams to me that a SCJ would know why certain suits were dismissed but Justice Scalia said he did not.
