something that has never been done before, not even by bush.

New and worse secrecy and immunity claims from the Obama DOJ - Glenn Greenwald - Salon.com

Quote:
But late Friday afternoon, the Obama DOJ filed the government's first response to EFF's lawsuit (.pdf), the first of its kind to seek damages against government officials under FISA, the Wiretap Act and other statutes, arising out of Bush's NSA program.

But the Obama DOJ demanded dismissal of the entire lawsuit based on (1) its Bush-mimicking claim that the "state secrets" privilege bars any lawsuits against the Bush administration for illegal spying, and (2) a brand new "sovereign immunity" claim of breathtaking scope -- never before advanced even by the Bush administration -- that the Patriot Act bars any lawsuits of any kind for illegal government surveillance unless there is "willful disclosure" of the illegally intercepted communications.
Well, well, well. It appears barry is going way, way beyond what bush claimed - as far as state secrets, the NSA wiretapping programs - and now - a brand spanking new never before invoked "sovereign immunity" claim.

Please, where are all the lefties (saggie?) who bellowed like beasts about bush,wire-tapping and the Patriot Act?

Let's just read this again;

Quote:
that the Patriot Act bars any lawsuits of any kind for illegal government surveillance unless there is "willful disclosure" of the illegally intercepted communications.

Quote:
In other words, beyond even the outrageously broad "state secrets" privilege invented by the Bush administration and now embraced fully by the Obama administration, the Obama DOJ has now invented a brand new claim of government immunity, one which literally asserts that the U.S. Government is free to intercept all of your communications (calls, emails and the like) and -- even if what they're doing is blatantly illegal and they know it's illegal -- you are barred from suing them unless they "willfully disclose" to the public what they have learned.
So, I'm sure the left will have no problem whatsoever with this. They must know that with obama at the helm spying and eavesdropping on tele calls and emails, why he would never abuse such a program - we can be sure they would have the best intentions, right? Even though what he is doing is so far out of the realm of lawful.

Surely if bush was deemed to be trashing/shredding the constitution due to the Patriot Act/Wiretapping, surely the left would have to feel that obama is presiding over a bonfire with the Constitution as fuel.......right?

I can't wait to see the spin.

Kevin Bankston of the Electronic Frontier Foundation, a lawyer for the customers, said Monday the filing was disappointing in light of the Obama presidential campaign's "unceasing criticism of Bush-era secrecy and promise for more transparency (http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2009/04/06/BARP16TJOQ.DTL&tsp=1 - broken link)."

It's Bush's fault Obama has to keep the wiretaps going.

Something about turning a freight train on a dime or some such. It's not like it's possible to do extraordinary things like shut down a detention center by exec order. Oh wait...

Isn't it always Bush's fault?

This might be difficult for the Obama supporters to explain...at least until the talking points are posted elsewhere telling them what to write...

Obama has his teleprompter, the bots have a secret internetprompter that tells them what to type. Or in the case of Dukester, what to cut and paste.

Disappointed in Obama for sure for this, but yet, he's on the right track, overall.
Bush was the = of last years Detroit Lions when it comes to the presidency.
Obama, in spite of this news, is an improvement.
CONS, WHY DON'T YOU STICK TO POSTING ACTUAL NEWS LIKE THIS AND QUIT POSTING ASININE POSTS LIKE "OBAMA'S A MUSLIM!", "OBAMA'S ARE A DISGRACE IN EUROPE!" "OBAMA IS A MARXIST LIKE STALIN!", "OBAMA'S A RACIST!", "OBAMA'S NOT A US CITIZEN!" AND ALL THE OTHER PATHETIC POSTS THAT ARE JUST LIKE THOSE IN THIS PARAGRAPH.
You'd actually gain something that is hard for most of you to comprehend, credibility.
