Did you read this? It takes what existed and makes it so that you cannot file a lawsuit against the government. So you can't say that it was far worse under Bush. At least then, you could being action against the government. So you are not going to get reform.
All Hail the Government State!!!
But the point is he's being criticized by many liberals... I don't recall the outrage from conservatives when Bush put this in motion. But-for Bush, this is not even an issue. Obama should be fought on this... and fought hard... but let's stop revising history and playing this childish game.
But late Friday afternoon, the Obama DOJ filed the government's first response to EFF's lawsuit (.pdf), the first of its kind to seek damages against government officials under FISA, the Wiretap Act and other statutes, arising out of Bush's NSA program. But the Obama DOJ demanded dismissal of the entire lawsuit based on (1) its Bush-mimicking claim that the "state secrets" privilege bars any lawsuits against the Bush administration for illegal spying, and (2) a brand new "sovereign immunity" claim of breathtaking scope -- never before advanced even by the Bush administration -- that the Patriot Act bars any lawsuits of any kind for illegal government surveillance unless there is "willful disclosure" of the illegally intercepted communications.
You think they actually care if the Constitution gets trampled on?
The issue was just that it wasn't them doing the trampling.

Very true. In fact the ONLY organizations that are taking the Fed to Court besides the defendents lawyers are the ACLU and the EFF Electronic Frontier Foundation....not the Libertarians, not the Ron Paul Supporters. Certainly not any "right wing' organizations.
Glenn Greenwald and Firedoglake and Digby blogs (Liberals) have been attending these court cases and reporting on them. They are front and center in fighting this.
But that doesn't matter to "fake Conservatives" ...they get their "Libertarian" on only when Dems are in controls...just to score political points.

I remember their defense was usually if you arent doing anything illegal then you have nothing to worry about.
Now they care? They should be ecstatic that Obama is keeping them safe(sarcasm).
I didn't agree with Bush, and I don't agree with Obama on this issue.
I do remember Bush backers claiming "It's no big deal. If you're not breaking the law, you have nothing to worry about," so I expect those same people to accept Obama's continuance of the program as no big deal, as well.
