I don't see how. You think a criminal stops & thinks "wait, if I turn my back, they can shoot me....best if I leave this one be". Yeah, I don't think so.

When someone turns his back, traditionally, he is no more threat. In fact you become the threat if your intent is to kill him.

So, could a mugger justifiably turn around again and kill you?

If and when they turned and reinitiated the attack any force necessary to stop that attack is lawful.

FYI, jut looked up the Florida statute regarding use of force and even police officers are not allowed to use deadly force against fleeing suspects.

Gotta admit, I dont think this will stand. The reasons cited by geofra and ovcatto being the most pertinent.

I thought shooting in self defense was already permissible. Citizens arrest is also permissible.

Now, if a homeless man is trying to sneak out some food from your house, that is a totally different story. You could always water him down with the water hose or at worst use pepper spray.

Ahhhhhh... so refreshing to see a step in the right direction. These types of criminals don't deserve to live as it is, if you didn't give them proper punishment like this instantaneously then they would probably get away with it after the "justice" system has processed them.

Yeah those harmless, feeble homeless people just sneaking in for a little bite to eat... just like little mice. I'm sure they run away all frightened too....
