Ted Kennedy was too ill to attend his own sister's funeral, and Robert Byrd is in bad health and is absent a lot from the Senate. Byrd is in his 90s and has served over fifty years in the Senate. Kennedy is in his late 70s, has served 47 years, and has malignant brain tumor.

Who has the authority to deem these men as too ill/mentally unstable to serve?

menatally unstable?... we would have to force all of Congress to retire...

Why should they be forced to retire, because you want them to? If they are still able to vote on issues, leave 'em be.

Well, they're wealthy so it will be their DOCTORS who decide their physical and mental health NOT their Insurance companies.

Strom Thurmond served until he was 100, and for the last ten years of his life he was constantly accompanied by two men whose job it was to stand him up when he needed to and keep him from falling over.

I don't recall anyone calling for his removal.

Senator Kennedy has requested the state law be changed to replace him in the event his vote is crucial in passing a health care plan. A 2004 law requires a special election be held, and would take about five months to fill the senatorial seat. Unfortunately for the dems who feared Mitt Romney would appoint a repub if Kerry became president, passed this law by a wide majority. Now, the law is coming back to haunt them. Personally, I think they should be forced to work until they drop over...like so many other Americans who don't have affordable, fair health insurance.
