Good point. Maybe we should go back to allowing kids to lay down in the back window deck of the car while we drive 70 mph.

Never did that. My parents cared about us. They buckled us into the back seat when we had cars that had seatbelts. My point was where do you stop with good intention laws? Some states have made it illegal to smoke in a car with a child inside. Some areas, last I heard, were looking to make smoking inside your own home illegal if a child is inside. Some were looking to banning smoking inside the home even if there's no child inside. Obama's looking to increase taxes on sodas to protect us from obesity. Some are looking to increase taxes or penalties on fast food restaurants (never mind the high calorie meals of traditional restaurants). At what point would you say is the government getting too intrusive into your personal home and rights?

Wondering how long it would take before Obama's name came up.

It's this simple:

Smoking around a child=child abuse.

Obama Open To Tax on Soda and Sugary Drinks - Political Hotsheet - CBS News
I brought it up because 1. it's true and 2. it's an example of nanny government. By your reasoning then shouldn't hollywood liberals stop defending Roman Polanski? What he did was far worse than a parent smoking in a car that had a child inside. Children shouldn't be allowed to skateboard cause it's too dangerous. Allowing a child to play football is child abuse cause it's too dangerous. That mother is feeding her child Pepsi! Arrest her! You let your child play out in the sun without sunscreen?! You're under arrest! Guess there'd be no more camping trips sitting around a campfire cause that's child abuse.

Well then go and petition your Senator for a law.
What's the punishment ? A year or two in jail for the smoker and foster care for the kid ?

Yep, foster care, where the kid might get exposed to a lot worse than tobacco smoke

No, no, no..we won't think that far. Just stop at accusing the smoker of child abuse and punish from there.

I like the stories wherein both parents are so hell-bent on demeaning each other in the custody battle that the only option available to a responsible jurisdiction becomes foster care. Then the child loses just because his/her parents are bitter imbeciles who value petty vindiction and "being right" in a fleeting short term far more than family stability in a long term.
