From states Attorney Generals, members of Congress, lawyers in general.

Law Suits Threatened Over Obamacare » The Foundry

Quote:
This is an indication that many States are concerned that the Federal Government is overreaching and violating the constitutional rights of citizens. The New York Times reports, “Mr. McCollum’s stance places him in line with the attorneys general of South Carolina and nearly a dozen other states who have also threatened to sue over the mandate.” The bill is yet to be signed into law and many Members of Congress are threatening to introduce legislation to repeal Obamacare and lawyers are lining up to challenge the constitutionality of the legislation.

VERO BEACH, Fla. — Florida’s attorney general questioned the constitutionality of the federal health care bill on Tuesday, calling on states to study whether to file suit to kill a provision requiring that individuals buy health insurance or pay a fine.

“It’s a tax on living,” Mr. McCollum said in a telephone conference call with reporters. “It’s a tax on people or a penalty on those who don’t do anything.”
Can the Congress actually force people to buy a product as a condition of their citizenship? I say hell no.

An excellent piece by Heritage on the issue.

Why the Personal Mandate to Buy Health Insurance Is Unprecedented and Unconstitutional

1994 CBO statement regarding mandate in Hillarycare;

Quote:
A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States. An individual mandate would have two features that, in combination, would make it unique. First, it would impose a duty on individuals as members of society. Second, it would require people to purchase a specific service that would be heavily regulated by the federal government.[1]
The very minute after obama signs any bill into law, the lawsuits will start.

Looks like political grandstanding to me:

Quote:
The attorney general, William McCollum, a Republican who is running for governor in 2010

I won't be as rude to you as you often are to others, but what are your credentials to say "hell no"? I thought you had a CS degree, not a JD.

This battle is far from over. As you said before, the minute the bill is signed into a law, the lawsuits will begin, and as the unconstitutionality begins to unfold, injunctions will be granted, Harry Reid will be defeated and hiding under a Nevada rock, Republicans will put a screeching halt to Obama's radical agenda, and America will finally rest easy for a bit.
