An intoxicated patient filed a complaint with the city after a Denver Health Medical Center doctor issued discharge instructions telling her to not "get drunk and fall, causing harm to your head or body."
Patient Karin Howe, of Littleton, a certified nurse aide, accused Dr. Yadavinder Sooch of issuing "outrageous discharge instructions" and said the hospital provided "substandard treatment," according to an intent-to-sue complaint obtained by CBS 4 News investigator Brian Maass. The mere fact that someone would even consider taking this case makes me nauseous.
Well the basis of her lawsuit should not be what the doctor said,(sticks and stones), but the fact that they didn't identify her hairline fracture and trauma from her internal brain injury. That was just medical negligence if they didn't at least do any x-rays.

I'm thinking if she was that unruly to have to be restrained in the E.R., it would have been pretty tough to get an exray or MRI. Just another case of tremendous lack of personal responsibility....((I'm gonna get drunk, be stupid, get hurt, cause others aggravation, sue them so I can drink Kettle One instead of Stoli....yup, its a plan.....)

Good point. But they have to show not just neglect but that it caused harm. If the delay in identifying the fracture didn't cause harm then there is no case.

I guess I was assuming there was harm done because she suffered trauma and was in the hospital for 2 days. However, I get the feeling we're not getting the whole story, so your probably right.
So she is too drunk to cooperate for tests that require you to be completely still, was abusive/obnoxious to the staff and I'm supposed to take her side in this? Nope, not gonna happen. As a volunteer EMT this is my reality all too often so I can understand all too well the frustration the doc/staff was feeling having to deal with her. I don't see the discharge orders as traumatizing, but more like words of good advice. More likely than not they were hoping that given some time she would sober up enough to be coorperative so testing could be done. There is way too much NOT being said about this case, leads me to wonder why.
