After Becker's term expires, there will be one Democrat and one Republican member of the board. The last time the board fell to two members the Supreme Court ruled it could not take any action.
They need a quorum in order to act. They soon will not be able to achieve that. I'm confident Obama will resort to recess appointments. The good news is that if he does indeed go that route, those terms will expire at the end of the Senate's next session. This is the Constitution in action.

He will probably ignore the FACT the Congress is NOT in recess. They have remained permanent session.
Could be we will see a lot of recess appointments. Obama could take the Teddy approach, if the Senate is not in session for 1 sec, appointments are made. Of course, he might wait til after his reelection to start doing that. He fully knows the danger of a Senate that refuses to work.
If someone is competent for the job, and the President appoints them, congress should swiftly approve them. If the program and agency is that bad, take it to the voters to end it, don't do it by the back door.
