I hope he takes it all the way to the Supreme Court. Even if he loses Bill O'Reilly is going to pay his fines and do what it takes to go after these nuts.

Why shouldn't he have to pay their legal costs? He was on the wrong side of a losing, frivolous lawsuit.

Why is it wrong? I think a lot of you don't understand the definition of "freedom of speech". As long as you're not inciting violence or endangering the public, you can say whatever you want in a public place, no matter how offensive others may find it. That's one of the best things about the United States, and I'm very grateful for it.

There's a difference between threatening someone and expressing a point of view. I'm all for freedom of expression; I'm not in favor of threatening violence.

If it was frivolous, he would'nt have won the initial case.

At some point people have got to get a little respect. Protesting at a funeral is a low act.

These are the idiots that protested at Heath Ledger's funeral, right?

There is also the concept of "fighting words", outlined above.

I would say that going to a funeral and telling the family you're glad their son is dead meets the test of speech that "by their very utterance inflict injury or tend to incite an immediate breach of the peace"

Perhaps if the court disagrees with this classification congress can put that concept into law via statute. Then Mr. Phelps and his ilk will get a very well deserved ass kicking at the next funeral they decide to attend.....
