The right is not a big homogenous block where everyone thinks the same way.
How are Glenn Beck and Peter King supposed to walk in step?

If he is a US citizen, then he is entitled to his rights as described in the Constitution. Pure and simple. McCain is wrong on this one....

So we can now ignore the Constitution whenever it's more convenient?

Check.

I think first we must distinguish between conservatives and neo-cons. Typically, when one says "right" or "the right," they are usually referring to neo-cons. Unfortunately, most republicans in politics today are neo-conservatives. All citizens are afforded rights as prescribed under the U.S. Constitution.

You still don't have a clue about that issue. Anyway, if the person you so vehemently defend is caught alive, he would be entitled to the rights.

Believe it or not (I'm in shock myself):
Miranda is NOT part of the Constitution. It is the name of some POS who got arrested, but said he was ignorant of his rights, and some POS judge said he had to be proactively advise by LEO of his rights. It isn't in the Constitution, it is a product of a judge.

I think folks are arguing about the wrong thing - and being misled to "bark up the wrong tree".

The division is not "left wing" and "right wing". Since 1935, the USA has been the United Socialist States of America.
(Left wing / collectivist)

Right now, the "official wings" are :
[] Do it quickly, and
[] Do it slowly.
The goal?
The People's Democratic Socialist Republic of America.

If you roll back to the founding generation, you will find that they had a whole different idea of what government was about.

For example, the Declaration of Independence spells out the two jobs of government:
1. Secure rights, and
2. Govern those who consent.
And if you didn't consent, you aren't governed, but your rights are still secure.

Got it?

There's no "fair share", no "share the wealth", no "welfare" (to be accurate, it was called pauperization), and no taxation of rights that are secured by government.

What properly indoctrinated and enumerated socialist Americans are not told, is that by their consent, did they surrender their RIGHT to life, liberty and property ownership, in exchange for "entitlements", "civil liberties", and "political liberties".

So, technically, you can't blame the government.
Enemy #1 is looking back at you in the mirror.

Glenn Beck was wrong, when he said YOU cannot change things by yourself. Once YOU withdraw consent, you will change things.

---------------------
Virginia Constitution, 1776.
SEC. 6. That elections of members to serve as representatives of the people, in assembly, ought to be free; and that all men, having sufficient evidence of permanent common interest with, and attachment to, the community, have the right of suffrage, and cannot be taxed or deprived of their property for public uses, without their own consent, or that of their representatives so elected, nor bound by any law to which they have not, in like manner, assembled, for the public good.
  • All men ... cannot be taxed without their own consent.
  • All men ... cannot be deprived of their property for public uses without their own consent.
  • All men ... cannot be bound by any law that is not for the public good.
In case you were thinking that "their representatives so elected" means that consent was not needed, remember that voters were limited to (a) property owners who (b) paid their taxes. Which means a vast number of people could not and did not give assent to any representation.

A judge? Try five Justices, Chief Justice Earl Warren, Justices Black, Douglas, Brennan, and Fortas.
