.....they feel the Government should be able to deny Constitutional rights to suspected criminals...

Think Progress » Conservatives Want To Deny U.S. Citizen Faisal Shahzad Miranda Rights, Ensuring He Won’t Be Convicted

“I think obviously that [mirandizing Shahzad] would be a serious mistake until we’ve — at least until we find out as much information as we have, and there are ways — legal ways — of delaying that.” — Sen. John McCain (R-AZ)

“I hope that [Attorney General Eric] Holder did discuss this with the intelligence community. If they believe they got enough from him, how much more should they get? Did they Mirandize him? I know he’s an American citizen but still.” — Rep. Peter King (R-NY)

I dont believe either of these individuals suggested we should deny constitutional rights to suspected criminals. They suggested that
1) delaying mirandizing Shahzad.. Something they can, and do to american citizens
2) Obtaining additional information..

Americans do NOT need mirandized upon your arrest. This isnt tv.

Miranda is not mentioned anywhere in the Constitution.

The Supreme Court decided all detained individuals should be advised of their rights, because most people are too ignorant to know their own Constitutional rights upon arrest.

Besides, it would be in the best interest to read Miranda rights to everyone regardless of their citizenship status, because if you don't, what they say will not be admissible in court. The last thing we would want is a terrorist to walk because the arresting officers did not read him his rights.

A terrorists wouldnt walk because he wasnt read his miranda rights. Just what he says cant be used against him. They can indeed arrest, and proceed with trial, using his actions, but not words against him, even without being mirandized.

This is where the OP fails..

Ah! The right wing just wants Americans to be denied legal rights for a little while so the the "authorities" can coerce information from them. Then they can have their legal rights back....LOL

Why? Because they perceive a good outcome from doing that.

Hows that for defending the Rule of Law?

......And these jokers have the nerve to gripe about illegal aliens breaking the law.....LOL

You complain about the rule of law not being followed, and its obvious you dont even know what the rule of law is...

Again, NO ONE needs mirandized in america who is arrested. You can indeed be arrested, go to trial, be found guilty, and go to jail, or face the death penalty without being mirandized. Its ONLY when you are being interviewed, and what you SAY/WILL be used against you in court that you need to be mirandized..

As long as they dont use what the man says in the court system after his arrested, he can indeed NOT be mirandized legally.. without breaking ANY rule of law or the Constitution.

To be fair, the arrested individual is an american citizen, arrested on american soil, and the act took place in america.. He indeed should be mirandized IF he is going to be interviewed. Not before, not afterwards. He can be held in jail for the next year facing trial without miranda rights being red to him, or he can be asked 1,000 questions, provided the answers cant be used in court against him..

Will he provide more information if he's not mirandized, knowing what he says wont be used against him.. Possibly, which is the point being the two Republicans in the OP quote..

The failure, is the OP believes one needs to be mirandized.. they are flat out wrong..
