Discrimination starts on the ground of inequality. An openly racist would be worse than a mouse if put under what would be a hostile condition. Government has to ensure that doesn't happen. The person can hate, speak out, but they can't openly discriminate if they are to take advantage of everything a society that operates on the philosophy of "all men are created equal".
