I moved to Florida with a verbal agreement to rent one of my brothers homes, I would be sharing rent with my sister who is already in Fl. I paid 6 mo. in advance, and moved down 1 1/2 mo early, (not staying in the home to be rented) I discovered right away I cant adjust to the climate, and havnt felt well since I arrived, I decided not to rent the house and return to co. I did give him 30 days notice even though I never moved in.
my question is: he said because I breached the agreement I cant get any of my monies back I put toward rent..it was a binding agreement..is this true, what are my rights..I cant seam to find an answer.. I just want to know for future agreements.. Help me..I dont want to have a problem with our relationship...it was an honest mistake

Nice brother - so what if he rents it in a week? Is he still going to mess with ya or give your money back! It is reasonable to pay for 1 month, and give him 1 months deposit - why would you ever give him 6 months rent in advance? You have to know him better than that. He obviously doesn't care about your relationship with him - I'd never do it again - he obviously doesn't care about his relationship with you, and thinks your a push over. You shouldn't be shy about discussing what's fair - keeping 1 month and keeping the deposit is what most landlords would do - that aren't very forgiving, most would return the deposit.

Common Sense lesson learned: a) NEVER have a verbal agreement, b) NEVER have financial agreements with family. It rarely ends well. Good luck to you back in CO. Sorry you couldn't adjust to our little paradise

I learned a long time ago, it's a bad idea to make deals with family.... ANYTHING involving money..

You are stuck buddy.. Sue him you most likely lose a Brother..
you Dont you lose money.. It depends on what is more important to you..

Money can always be replaced...
