I guess they might be caught on how the income taxes are filed.... but not sure. When I was in transition, the house where I payed the most property taxes, was the house that I used to file until I eventually moved into the house I have in Florida and sold the other.

This info was on the Property Appraisers website. I stand corrected. I thought it was 6 months and a day. It could be less or more.



How many days out of the year does someone have to live in Florida to be eligible for homestead exemption?

You must reside on your homestead property as your primary residence. However, there is no particular amount of time you have to be physically present on the property to qualify for homestead exemption. To qualify for homestead exemption, you have to declare Florida as your permanent residence. For example, if you vote, you must vote in Florida. If you drive, you must have a Florida driver’s license. Your home address on your federal income tax return should be Florida.There is no specific amount of time you must spend in Florida.

Thanks for all the replies. We have decided to talk to a tax attorney for a "legal" answer. We are not looking to break any tax laws; just want to take advantage of any legitimate tax breaks that are available with having 2 homes. And again, I repeat that we are not looking to have a homestead exemption on both houses. We know by law that you cannot do that.

That's 2 of us. We are not eligible for the Homestead Exemption as both husband and wife have to be florida residents to qualify. In a couple of years we can do that. But I can become a florida resident and my wife can stay a Jersey resident sort of the same situation as you are in. Charlotte County has a good website pertaining to what qualifies your florida residency and eventually the homestead exemption if needed. Good luck.

By definition it can still is a bit dicey can it not?.. Primary Residence would you think that meant where you spend the majority of your time? I know for a fact there are numerous couples in PC and PG who claim two homes as homesteads..They each chose a different state and comply for that state. BTW NOT FRIENDS just people dumb enough to offer such info at cocktail parties with the, look at me see how smart am... I attitude..I keep folks like that at arms reach..

I seem to remember filing for our homestead exemption on line. Answered a bunch of questions including date of sale of our home up North. We didn't sign anything in front of anyone. Every year we get a post card asking if anything has changed, if not you do nothing. Maybe things have changed in the last 4 years but that is how we did it.

I remember reading about this in other posts but I,m too lazy to look right now.

Last year we had planned to buy our Fl house. I would move down and claim partial homestead exemption while my wife stayed back in Oh and finished up her two years working and then join me. Then we would be able to take the full exemption.

I could be wrong but I'm pretty sure that's how it works.

We moved to Fl 2 years ago full time. Because we hadn't sold our NJ home yet the Charlotte County Appraisers Office required us to get a letter from NJ certifying that we had not applied for the 2013 Homestead Rebate. NJ does have a homestead type program they just call it a Rebate. It took almost 8 months to received the letter from NJ. My wife & I had to both show the proofs of FL residence and also sign an affidavit.
