What recourse do I have If the builder has not built our house according to the plan we signed off on and contracted on? We have two extra stair risers coming into a 2nd floor playroom from an attic that do not show in the brochure OR the construction documents. I understand that brochures are only renderings but these risers do not show in the permitted construction documents either. The also framed out our finished attic incorrectly. What can I do? Since the house is completely framed, should I complain and get interior upgrages to make up for this difference?? Let me know what you think??

It depends on what it states in your contract for one. Some construction drawings aren't completely accurate. Especially on things like staircases. There have been some code changes effecting the heights of risers and depth of steps that could not have been indicated on the drawing you saw. But, if they are site built stairs, maybe they were framed wrong and they can be fixed. As far as the framing of the attic, I'm assuming they are walls? If so, they should be able to fix that.

Have you questioned the builder about these issues yet?

Make them stop construction now and remedy it. Notify them by phone, fax and certified letter of the issues. Don't let them proceed till it's fixed. With new construction if you wait they will just keep right on going.
