I've actually contacted 2 lawyers. One is a close friend. They all said the best you can do is get it in writing since the wall and the slope are not in your yard or land

I agree with what everyone else is saying! Please do not close on that house until whatever you want is finished. This exact same situation happened to my mother a few years back and she closed the deal anyway (before I was in real Estate and could tell her any better), and they refused to do anything. She had to resort to stones and a drainage easement acrossed the side of her and her neighbor's lot. It was very ugly & she would not have done that except for the fact the first good rain almost flooded our house! I wanted to shar this with you because I know flooding was a big concern of yours!
