I purchased a new home in May 2013. We did inspection before purchasing, there was a list of problems on the inspection report and the builder came back told us that they performed the repair and walked though.

Shortly after we moved in , we found one problem on the inspection report was not fixed at all while they did tell us it was fixed. We found another big problem and ask them to fix under the one year warranty. They did cosmetically fix, however the result is not good.

We raise all theproblems at 30 days check up. Since then, they changed at least 6 coordinatorsto work with us (I am feeling that's the strategy they use). but still did not get problems fixed.

Now, I am not able to hold of anybody. The coordinator pissed me of coupletimes, saying he is coming, but did not show up. I called the company, gotauto voice service and directed me to different people. I have no idea who is who. The company website left a mail box for homeowner care which routes to thecoordinator. I also tried to reach my buyer agent, but she just did not respond.

Please help me if you know what I should do. Is there any authority I can gowith? Should I take legal path? I am reaching the end of one year warranty anddesperately want to have the problems solved.

Sorry to say, but your first mistake was not having the same inspector come back to verify that all identified repairs were complete and performed correctly before closing instead of assuming the builder took care of everything.

You did not detail what the specific problems are and any dollar amount estimates required to make repairs, so the first step in my opinion is to get written repair estimates from contractors. After that you can decide the next steps including asking the builder to cover and/or reimburse you for those costs or make the necessary repairs by a specified date. If he refuses, then you can possibly take them to small claims court for reimbursement, again depending on the dollar amounts involved, and at the very least file complaints with both the building contractor licensing board and the state attorney generals office for failure to honor the home warranty terms.

If you want their attention, file a complaint with N.C. General Contractors Licensure Board. Even sending them a message threatening to do so will likely get a call back. Tract builders have a ridiculous amount of turnover in their workforce so go higher up the chain.

Yup! Been having issues with a tract builder in Durham.

My client has had a list of items that need attention. In the last few months, the list of people that have moved on is amazing, including the customer service people for that particular builder! So...this squeaky wheel is getting some oil but it has taken a great deal of phone calls AND emails!!!

Thanks. Yes, my mistake that not having the inspector back for the double check.
Normally, you need to already have out of pocket expense then go to small claim for reimbursement, right?

Before you go to small claims (and yes there is a small out of pocket expense for doing so) contact the NC Contractors Licensure Board. Your builder WILL answer the complaint! Make sure you have your ducks lined up (documentation).
