There is Duke's Mayonnaise, Duke Energy, Duke Reality, even a GI Joe character named Duke. I don't know why Duke University thinks they are the only ones who can use the name.
I agree that it would be difficult to confuse that label with anything about Duke University, but I could see some potential confusion when speaking of the brand name without benefit of a visual. I think it would have made more sense to call it The Duke's Kentucky Bourbon. "The Duke" is absolutely John Wayne (at least in the U.S.); "Duke" can be many more things. Still, I don't think the issue is really that important.
I found it somewhat surprising that the University was blocking the family in the past. Do they realize there are plenty of people not living or from NC who have never heard of Duke University? <gasp> But they know who "The Duke" is.
