Thanks all, the ticket actually says a speed of 40 MPH in a 35. It was not a school or work zone, was at the bottom of the hill on Sunnybrook Road. No one in my household has ever had a ticket. I thought I had "heard" in the past that for tickets as minor as this, the DA will often toss them out, but that's just rumor. I had also "heard" that police didn't give tickets for 5 MPH over because there can be that much variability in their radar versus a speedometer, but I guess that's a MYTH!
It was also the last day of the month so don't know of the whole "quota" thing is true or not. Just annoys me so bad when we're all very contentious drivers here, have never had any tickets or accidents and I see such aggressive, fast drivers everyday!
I had something similar happen to me a few years ago.
I just went to the courthouse, and the DA seemed shocked that I was even issued a ticket for such a minor thing, and just dismissed it due to my clean record.
This was in Morrisville, and the cop's behavior was quite bizarre, he claimed he saw me speeding somewhere else, followed me to my work parking area, and then stopped me. I was so shocked that I got a ticket and wondered if that was even legal. He also asked me a bunch of unrelated questions, about where I was going etc. and seemed surprised that I work in that building. I still don't understand his rationale.
Morrisville PD is quite aggressive, and most of my co-workers have a story to tell.
Holly Springs and Garner are famous for the 5-over ticketing. Be very observant of your speed on Holly Springs Rd., Sunset Lake Road (both 35mph zones) and in Garner on Timber (especially the 35mph area), Aversboro, Vandora Springs and Buffalo.
And let's not forget everyone's favorite.... McDowell Street going into downtown Raleigh. There's usually a cop sitting under the MLK bridge.
Speeding tickets, in general, are a snap to beat in court.
Police rely on a roadside confession or "no contest" plea. Radar guns are not infallible... Ask any officer if their technology is 100% accurate.

Wake is the toughest on speeding tickets around. No non-moving violation substitutes are allowed. Having said that, I would definitely either call a lawyer, or show up to discuss w the DA/clerk on the court date. If they don't drop the 5 over, I'd get a continuance and hire a lawyer. That's disgusting.
What was the cops demeanor (and yours) when you were pulled over? What was that interaction like?
Also as one poster said, never ever ever say how fast you were going, if you were aware what the speed limit was, etc. Instant confession.
