That doesn't mean the furniture store was evicted for scamming. The store had already a planned closing date when the customers were "scammed". Not saying it's the customers fault but I know I wouldn't go to a store that is already saying they are closing and try to order furniture. I definitely only pay cash when it's a "cash and carry" transaction. Just my opinion but it seems like the customers were pretty naive to me.

There were 9 formal complaints filed and numerous stories of customers who paid and never received. What do you call that? The article I read did not make it clear that everyone bought after the closing was announced. Also look at online reviews.

I'm not saying the business was innocent of any wrongdoing. There's a reason why they went out of business. That's why the free market works so well.
What I am saying it is my opinion maybe the customers should have thought about it a little better. Would you pay cash for a sofa that had to be ordered from a business that already has "going out of business" plastered on it's front window? Let's be realistic here.

No, the thieving owner took advantage of vulnerable customers by lying that he had the merchandise but not in the store.
Years ago, Homelife Furniture on Glenwood Avenue pulled the same stunt taking money a few days before filing bankruptcy for items not in stock.
A bit of rattling the jail doors convinced the owners that fraudulent debts to the defrauded customers cannot be discharged and may become a federal crime. The customers were made whole.
Secret is to only pay with a credit card (NO DEBITS) and have the contract include a condition for delivery within 60 days or the customer gets a full refund. Your credit card company must accept this dispute and charge the transaction back to the merchant's bank. This is part of the Fair Cedit Billing Act.
I seriously doubt a store would get evicted for scamming customers. Given all the sweepstakes parlors around, which are illegal (the sweepstakes games) in NC, it appears to me that landlords could care less what is operating on their property as long as the rent is paid.
