The reason is now that they started constructing and found out that there is a storm water drain in my backyard and it is very deep. It is a town house, every thing is excellent except that.

Now when I go to the lot I am not liking it. what shall I do?

If the only problem is the storm water drain, I recommend meeting with your realtor and an attorney, and then meeting with the builder to see if there is a better solution that doesn't mean walking away from your deposit. You may be able to convince the builder to let you transfer your deposit to a different townhome in the same community. Or come up with a way to hide or minimize the appearance of the drain.

What builder is this since$9k is a lot to ask... One option is to explore how you can't secure financing maybe don't provide the down payment support... Get me?

Have you asked the builder? Like I said, unless it's a really unusual situation like a truly custom build, if you are willing to leave the $9k on the table, I'm sure you will have no problem getting out. They will just turn around and sell the house to someone else as a spec house.

They might even let you out for less than the $9k if they are selling well. Why not ask?

I have to wonder if the OP bought before the infrastructure was complete.
We have many builders "Pre-selling" before utilities are in, and the site plans used for marketing are extremely vague.
If the OP was not notified of the drain, it may be possible to get the money back. It is worth trying.
