I registered my daughter in a Wake county school (Raleigh). My ex was still in NY (he moved to NC). I have since moved to another town. I received a letter saying that my daughter's base school would now be in the town I currently live.


My question: does anyone know if my ex can go to her current school and transfer her (without my permission or signature) even though my name and address is on her all her school documents . We have joint legal and residential custody. (at the time of registration, I had primary residential custody for school purposes).


We will be getting a mediator in the near future, but just looking for insight and how this may work.

It should all depend on what the legal documents say. Maybe it would be best to consult your attorney and see what they have to say.

If you and Ex are in agreement, it should not be a problem. If you both have joint custody, it should not be a problem. I'm not a lawyer, but in my semi-related experience, it should be fine, as you are both legal custodians.

If you are on good terms, and the school is questioning that, ask them to give you the documentation they need for you to fill out, then both of you fill it out, and have it notarized. Guessing here, but I would think that should satisfy them, they are probably just CYA'ing...

It sounds like she is afraid he is going to register the child at the school closest to him...not that they are trying to get her into another school based on dad's residence, based on her "without me permission or signature" statement.
