If one lives in a triangle community with HOA, does one need permission to build a pool in their own backyard? Does this type of request usually gets approved?

Each HOA is different, but in short - yes you need approval. You usually need approval from the HOA do anything architectural - new garage, driveway, fence, etc. You should have your list of covenants which state what is and is not acceptable in your neighborhood. Look that over. You'll most likely need to submit your pool plan to the Board, or developer if you have no board yet, and they should approve it quickly and without any issue as long as you aren't breaking any rules.

+1 to Luna. I never understand why people post here instead of calling their HOA offices. Better yet, it's written right in the bylaws and covenants that you were probably given a copy of, or if not, they are online at the register of deeds website.

A lot of times the HOA guidlines will spell out exactly what you need to get approved. So while you need "approval" as long as you follow the guidelines you should be OK.

Yes, you will need permission, some HOA's are MUCH more stringent than others. Along with the HOA, you also need to get permits from the town you live in, and if you are not in a town (we are in wake county but not within the town limits of wake forest), then we get a permit from wake county.

I think the reason fidodido has not checked with his HOA is that they do not yet have an HOA. They recently moved to the area and are renting & looking to buy in HOA governed communities (gleaned from his/her recent posts).

Many people are unfamiliar with the far reaching scope that HOAs have so his/her question was more general as in how much control do they have over you. And likely "we found a house we like but want to put a pool in - can we or will we buy it and find out that we are not allowed to?" . Just a wild stab in the dark... Crystal ball is in for a tune-up!

To fidodido - if you have an HOA often times you have to ask for permission for a great deal of things... be sure that even IF the HOA will allow it that the setbacks on the lot will allow it based on the land development ordinances.

I was just gathering covenants and info. for a listing. The HOA is Pindell-Wilson and they have a good 4 pages of "questions and answers" about HOA. Of course, it is THEIR association but the answers are very similar to all HOAs.

The HOAs that I have been in both banned pools (though hot tubs were allowed), but I know a couple of people who live in HOA controlled beighborhoods that do have backyard pools (Preston and Cameron Pond), so you should definitely check any property you are interested in looking at to be sure you will be OK.

Depending on the sellers motivation if you haven't yet purchased, you could ask them to get something in writing from the HOA that building a pool would be acceptable (following guidelines of course).
