If the agent forgot, that's one thing......but if that is the standard way of doing business, it needs to stop. The fact the agent "slipped it into the paperwork" and said nothing does not bode well, at all. That just slimed up the situation to a perfect stench.
We all know what would happen if that were a mortgage that someone forgot to disclose a fee on.......I keep hearing the CFPB is just itching to get their grubby little paws on the Real Estate biz......NAR knows it, feels the crosshairs, and is the reason for a not-too-long-ago bump in dues, all 100% of the difference going to lobbyists. <sorry, stopping here - could keep ranting, don't want to hijack>
Sorry, but I don't understand why you got so upset when Bernie disagreed with you--especially since he was polite almost to a fault. I, too, also disagree that the OP needed to work this out with his landlord. The OP didn't need to work this out with anyone since nothing was owed.
One thing we can all agree on: the agent screwed up.
