Attic Pests (sellers, sale, house, cost)

If you buy a house and within a few days you hear rodents in the walls or attic; what is the seller's responsibility after the sale is completed. Seems like the seller should have liability.

Can you prove the pests were there before the sale? Can you prove the sellers knew about the pests? Can you show that you did your due diligence prior to the sale and it was not apparent?

Most importantly, is it worth the hassle & cost to hire a lawyer to take action?
