I have a listing which is currently on the MLS.

Thursday I got two texts about the listing from two different agents, Agent A and Agent B, wanting to show the property Friday morning. I could not work out the time with either agent so I made an appointment for Saturday morning with Agent A and Monday afternoon with Agent B.

I got some pretty aggressive texts from Agent B in the interim which struck me as odd.

Saturday morning, I showed to Agent A and the client (who is Jean but Jean is not present) best friend who owns the property next door. The best friend told me that I could possibly hear from another agent but Agent A was the agent (he sells a majority of the properties in this area and is an expert). I texted Agent B and asked her if this Monday showing was for Jean and she said, "yes".

Agent B starts sending me really aggressive texts out of the blue and starts threatening me.

I call Agent A to confirm that he is the agent of choice and he said, "yes, and we will be sending you an offer".

The threatening texts are bothering me. She's threatening to badmouth me to other agents, turn me in to FREC, and other stuff.

While I haven't done anything wrong, what would you do in this situation?

Evidently, while waiting to hear back from Agent A, Jean and the best friend got on Zillow, saw my listing, and contacted Agent B.

Just tell Agent B that it appears that Jean has another agent. Ask Agent B to send you the signed representation agreement that she has with Jean.

In Oregon, those threats would violate REA administrative rules and could cause a suspension. Do you have any rules like that there?

It would be a no brainer for me.

"I clarified the agency relationship based on your concerns and the buyers confirmed they are working with another agent. Apparently, they got impatient and shot off communication with you during their impatience. If you need to contact FREC, here is a link to the form for complaints. Save those texts. If it were me, i'd forward them to Agent B's broker and your own broker and the local bd of realtors....but at least save them for future reference.

I don't think you did anything wrong but don't waste any more energy on this. Call your broker and let him/her work it out with the other broker. IMO, that's why you pay your split in the first place.

Me personally, I'd tell agent B to shove it where the sun don't shine and call the Buyer. It's the Buyers selection which agent they choose.

I'd also warn my Sellers in case Agent B submits an offer. Big red flags.

Have you ever directly conversed with this Jean or have you seen any paperwork that would establish an agency relationship with her signature on it? Also, it sounds like she hasn't seen the property and personally I'm always very wary of accepting an offer from a buyer who hasn't seen the house. There are just a ton of issues here. Some for you to figure out. Some for A & B to worry about. Personally, I would pay the agent that submits the offer and then let the two of them work it out. If you keep receiving threats report the agent to the appropriate RE authority in your area or even call the police if it reaches that point.

I've turned it over to my broker.

MikePRU, buying sight unseen isn't uncommon here. In a race for hot properties, it happens quite frequently.

Thanks for all the replies, I'm letting my broker deal with it.

In the interim, Jean is coming to see the condo Friday.
