We always like to think or believe that the general public, will have some sort of allegiance, and I know most of us, like to always ask up front, are you using or do you already have an agent. I recieve a lot of buyers, and do lots of work to help locate, find and show, but had my first this week. I had met with client, made several trips, probably showed around 20 plus, met the family, husband, then father in law, and even helped set a meeting with mortagage folks. We put in a couple of contracts, that did not work, and when we finally found a good deal, only in range of 115,000, we put in our contract, and asked for closing costs, and seller came back with an increased offer, above the list, to cover closing. Client got mad and because they would not counter with any concessions, they went two days later, made same offer with a new agent. I learned this when the listing agent, asked me later, and believe it or not, they had made the identical offer again. I had an agency signed contract, but disapointedly, just moved on, after I sent a letter about my disappointment. Any other out there with the same bad luck.

Did they end up buying that house? This appears to me to be a text book case of procuring cause, where you are entitled to the commission.

I would discuss that with my broker, and watch the property closely. If it closes then you would file for the commission.

Thanks Captain, no the deal feel thru, to a better offer. I just developed a new friend with that listing agent, for having the decency of telling me.
