My wife and I have been looking at buying on and off for a while now. Our attitude was if we see the right house then we'll put in an offer type of thing. Anyway a short sale came up in the exact area we like. I called the listing agent and asked to be show the house telling him we didnt have a realtor and didn't want one but he could act as buyers agent and get both commisions. He was all over this and we saw the house and offered list price. The offer is gone to the bank as it was the only offer made.
Now if we get this house that's great good luck to the realtor. However if we dont get it for whatever reason are we now obliged to use this guy for other properties we may find?? We signed a buyer representaion agreement - non-exclusive. I noticed it specifies the house in section 4 but it also gives a timeline of four months from the date of offer.
The terms and responsibilities should be spelled out in the agreement. From what you wrote, if it's non-exclusive, then you can work with other agents, other than for this specific house for 4 months. Your agent probably used 4 months since most short sales can take months to resolve. You should also review with your agent to be sure this is correct.
