Thank You to all of you for info. If I do MLS listing through Flat Fee service and later on say after 30 days decide to go with RE agent, can that agent continue with my MLS listing on his name and refund me my partial fee ?

Whether you can terminate your listing agreement and receive any part of the fee is up to your contract with the brokerage.

One of the reasons they do what they do for a small fee is that they have standard terms like a 6 month listing period and no refunds. Then again, all fees and terms are negotiable, so give it a whirl. And let us know how you do.

One agency cannot "continue" another agency's listing. You would get a new MLS number, new pictures and copy. As for refunding your fee, you would have to get in a long line of customers requesting the same thing.

Flat fee companies will require that you pay them upfront. They don't care if your house sells or not. They already got their paycheck and they don't refund anything.

If you hire an agent, they will get paid once the house sells so they will work hard at getting you a contract.

So you are wanting your "NEW" listing agent to give you a partial refund on what you spent on your Flat Fee service? Incredible,,,,

As mentioned by others, these are legal contracts between parties, one must be cancelled before a new one can be entered into.

I don't believe most people understand how their local MLS systems functions and that the local Real Estate companies in the area contribute to and pay money to support which is a private system and requires hundreds or thousands of agents paying monthly fees to keep it alive.

I've always figured most people believe it's some data base that is owned by 1 company like an IBM or Google who sells access to the data or provides it free to the public with advertising.

I think a lot of the confusion comes from the term "flat Fee MLS", in actuality it is discount listing with the world laziest real estate agent....

Flat fee agreements might get you in the MLS but that's about it! Without commissions you won't get any showings. Plus there is so much inventory it's difficult to get noticed. You might as well just try doing a FSBO - but remember, agents are not likely to bring buyers to you for free!

You will want to study up on all the required disclosures (federal & state) these days a simple mistake can cost big bucks. i.e failure to correctly disclose lead based paint (if built prior to 1978) can cost you a $50,000.00 fine! Be sure to have a title company lined up prior to offering the home for sale - don't forget to look into your costs. Please be careful.

Prior to becoming a licensed broker, I had sold homes by myself as well as having used Realtors. If you have the dedication - you have the time, can effectively do marketing (free & paid) and are well versed with real estate law in your state - you can do it. It helps if you have a background in sales and can view your home and the transaction in a very objective manner.
