So we are in the process of selling our condo, and have a question regarding an item if it should be included in the disclosure or not.

We have a front load washer that is located on the 2nd floor of a Condo unit, and it's wood frame construction. Anytime the washer is in it's spin cycle the washer will vibrate, you can also feel it if you are standing there or if you are on the 3rd floor you can feel a bit of vibration.

To include or not to include...

When in doubt, best to disclose. Since you seem to imply that the washer is included, the buyer should be made aware of it's condition and affect on the property.

Many (?most) states have worked out what MUST be disclosed. Anytime you go beyond that you RISK exposing yourself to liabilities beyond the legal requirements...

Most all front load washers vibrate, mine does too. When it goes into spin cycle it's like a turbo jet taking off! If it's really bad it needs to be leveled. I would never have thought that this would be an issue that would need to be disclosed. Certainly not one of the items on the disclosure in my state.

OK, my state says all known material facts affecting the home must be disclosed, with few exceptions. An appliance included in the sale that causes the home to vibrate would seem to be a material fact. Yes, it's minor, and probably can easily be resolved with a new washer or repair, or the buyer may not care. The OP should check disclosure requirements in their state.

Better to disclose and have the buyer think "that's no big deal" than to have the buyer question it later and assume you were hiding something and get lawyered up!

Update: Thanks everyone for your advice, I went ahead and had it disclosed in the contract. We are now under contract.. fingers crossed for the the next steps..

Nah, its an appliance, replaceable by anyone. All washing machines vibrate. I wouldn't have added that to the disclosure, but that's just me.
