I talked to one attorney today and will meet with another tomorrow. I don't have much of a defense, but the attorney thinks they are crazy because my net worth is negative. He said they can't touch my wages, 401k, and homestead. They can go after my immense collection of stocks worth a total of $1851.95 and dwindling. I have a small gold coin too (shhh don't tell them). For the first time since I started having debts, I'm happy to have a negative net worth.

This is the thing I'm not understanding about this deal. Why would they spend the money to bring a suit when they are unlikely to collect if they win? Why would they want you to proceed with buying a condo when you don't have financing or cash to pay outright? This whole deal doesn't make sense to me.. I live in Plano and I wish I knew who these people were. I don't think it would be prudent for you to say on this forum though.

Just search Google for preston tulane (those are two streets that intersect). I don't think they can sue me for that, and I don't care if they read this thread. I'm being careful with what I say now.

Lawsuits are filed to protect rights -
Also, until a suit is filed, and the discovery process begins, plaintiffs often do not know the financial "health" of the defendant
The sales agent knows that I have a rental home, because I told her about it in one of our earlier meetings. I think she thinks there's more equity in it than there really is. It's negligible. The financial paragraph was deleted, because the contract is numbered 1, 2, 3, 5, 6 etc...
and paragraph 6 references paragraph 4 (the financial paragraph). It must have been deleted hastily.
It does not, but the case is in my lawyer's hands now. I'm just mentally gearing up for battle. I did everything in good faith and I even paid the earnest money, so I was not a flaky buyer. There is a silver lining. The lawyer asked me to develop some software for him so that's something I look forward to.
Sorry to hear about this mess. Good luck to you and please keep us updated on how this goes.
