I have an office condo in a desirable location and building that i want to sell or lease. I was referred to a reputable realtor, we signed the contract on january 31 and to this date has not put a For Sale sign in front of the building. I got the okay from our board. When i called him to ask about the sign, i was told the city wasn't keen on 4 x 8 commercial signs and he was waiting to get the correct size (4 x4). That was one month ago.

I left two voice messages and he has not returned the calls. I called the owner of the real estate company to see if my realtor was ok, because who knows he could be ill and i don't want to bother an ill man. I was assured he is in good health. When i questioned the sign. Mind you, the building across the street has a 4x4 sign. I was told that they had to get approval from re-max headquarters due to the logo having to be resized, etc. Bottom line, a whole lot of bunk. I said "it takes two months?."

My one year contract has a cancellation clause of $595. This man has done the bare minimum. I even gave him some of the office photos - he did take some photos as well. He doesn't call me. I am the one who has initiated all communication. Do i have any recourse?

I appreciate your feedback and recommendations.

None of us here are attorneys or know what's in your agreement. For a small fee you should get an attorney in your area to review and give you an opinion.
