How do I fire this shady property manager? I hired him September 2013. In the contract it states I have to give him a 90-day notice if I am terminating his services. I got sick with a terminal illness and had to have chemo. I missed the deadline to notify him. He took money from me for repairs and painting that I found out were not done. He allowed the tenant to have a pit bull. I passed by the property the yard was uncut and debris scattered in the yard. There were about 50 beer cans piled up on the ground beside the porch. He even allowed tenant to get 3 months behind in rent. He allowed him to make partial payments to get caught up and he still owes half of last month and all of this month and here it is October 22nd. I gave the property manager money to start the eviction process. I have a receipt. He literally begged me to just wait and see if he makes a payment 3 days later. I agreed but left my money there. Property manager sent me a note with another partial payment saying that by law he could not refuse his payment and he couldn't evict him because he was making payments. This was about 3 weeks ago. I called and asked for a refund on getting the eviction started and he said he has to check with the processor to see where that money went. Lying thru his teeth. Now it was agreed before I left his office to put a hold on the eviction. I feel he's just trying to keep my money because he should no by now I am very dissatisfied with his managing practices. Is that true? Can u not evict someone who constantly make partial payments? I want to get rid of the tenant and property manager. Please help with any advice. Thanks in advance.

Yes, attorney. Could be solved with a simple letter from the attorney. The manager is slimey and dishonorable. You are not well. The tenant could be dangerous if drunk enough. So just go to the attorney.
