Not a realtor, but listings are wrong all the time as far as the monthly fees. The realtors use one figure, then its on teh market a while and they never revise the listing. Then different realtors will look them up, and use their figures for their own listings.
I've had phone calls from agents saying that there's 3 different numbers on the MLS, which is the true dues etc.
I would think that the buyer should have talked with the HOA at some point during their due diligence and gotten the hoa's info and true amounts.
The buyers agent did not include a due diligence or a kick-out clause, or an inspection clause, or a complete financing contingency. So this was learned after acceptance with an escrow amount being held by listing agency. Mess.
No due diligence. Incorrect information on dues. Mystery about who owes back dues. What a mess.
Sounds like the buyer needs to talk the the broker to get some help on this as the agent is clearly in over his/her head.
