I would never buy real estate without involving a real estate attorney.
Who did the title and search and how current is it?
Who saw to all the necessary inspections, including termites whose colonies carry off children's playhouses down here?
Find a reputable real estate attorney and pay the bill; it could possibly be the best money you have ever spent, or will spend.
If the Sellers balk at the idea, I would run not walk to my car and start searching again.
We bought an additional ten acres on the other side of fence, directly from the RE agent that owned it, and I didn't even consider doing THAT without an RE attorney
You don't need an attorney to buy or sell real estate. I buy and sell properties several times a year and have never used an attorney. Most people in TN use title companies to close the transaction and they are the ones that due the title search, review the deed, etc.. Most title companies have a real estate attorney on staff anyway. Attorneys can be really slow and expensive compared to title companies. I would suggest just finding a good title company and closing with them.
Is it advisable to retain a lawyer for a closing in TN?
A lot of people I've spoken with said it's not necessary, but being from Ny I'm not used to this.
Is this the case, or am I being paranoid.
