I hope you've been in contact with an attorney, OP. The fact that they think you should just wait until they complete the entire build seems ridiculous and I agree with the many others who have said that you want to get out of this contract and not have to deal with this builder.

Hello all. Hope everyone's having a great Holiday season.

Hired a professional and reputed structural engineer. Took him to the site and he took bunch of pictures and readings (level). His comments reflect most of the comments on this post. Improper construction (too soon backfill has caused the problem).

I am waiting on the formal report and ways to resolve the cracks; which I want to give to builder and demand him to engage a structural engineer (from his side) to review and address the issue (cracks) with written recommendations from structural engineer.

I also talked to my lawyer about the whole situation and if the builder doesn't get his structural engineer and work with proper written recommendations., I definitely want to take this to the town inspector and higher ups.

But I am still worried as the builder is not at all co-operative with this situation. I will keep updated and please do keep posting any comments/ideas.

Did your attorney offer advice on getting out of the contract altogether? To me, that's the preferable option.

That the builder would try to push this mess off on you makes me wonder if he isn't just a complete jerk, or possibly is he too broke and desperate to want to do business with?
A reputable and financially sound builder would eat this foundation, kiss your butt a little, and offer to rework the site and repour or let you out of contract, your choice.

Of course, if you get close to legal proceedings, you may want to lay low on the updates.

I see you live in MA. Is this a local builder you're dealing with or a national one (i.e. Toll Bros, Pulte, etc.)?
