We bought our lot 2 years ago. In the past year we have a new neighbor that has put his fence 14 feet on to our lot and his garage is 1 1/2 feet onto our property. It appears that they did not get any permits. We are putting a modular home in this week and after we requested a survey there is concern about our new neighbor being on our property. What does this do with title insurance and everything else?

Not sure I understand. After you bought your lot, your neighbor built a fence on your property and then a garage? Why didn't you say anything when it happened?

We live 3 hours from there. This new guy just put everything in less then about 6 months ago. We did not plan on building until I could retire from teaching. Life changed so we went ahead to build the modular home and had another survey done last week to make sure we were ok with everything.

Have you brought this to his attention, with your survey in hand? Does your new survey match the survey from when you bought the lot?

It is time to lawyer up but first decide what you want to do. If you have no problems with the fence and garage then consider deeding/selling that piece of land to the neighbor. If you have problems with it, than ask it be ripped down. Do not ignore the issue. Deal with it.

Our survey matches. We called Bill who lives across the street from our lot to get Charlie's phone number since they are new friends. Bill said he would let Charlie know he had to move his garage and fence but did not give us his number. We are going down this weekend. Our loan closes tomorrow, the modular has been built, and they are doing the footers tomorrow.

Do not delay - get a lawyer. If you do not deal with this issue, it will create bigger problems.

x2. This is a big problem. I wouldn't say word one to the person. There are many questions involving sale of your lot, permits after construction, code violations, among many others. They are what you will pay a real estate attorney to ask and answer. The problem grows larger daily.

If you don't know a GOOD lawyer, let me suggest you call your bank and ask who handles their commercial business. Call that person and ask they give you the name of someone who would handle this non-commercial matter. Chances are they'll have someone in their firm who is competent. Beats throwing darts at the phone book. Good luck. I feel for you.
