Heres the deal,
My wife and I started this deal on buying a manufactored house back in Oct. of 2007. It is now April and and the house is not finished as we ordered it. The contractors has been hit wit all sort of bad weather and now the seller is trying to force us to close on a deal that is not complet. My question is, can they leagelly do that?

I know this is obvious, but you need a real estate lawyer to sort this out. Also, if the home is finished but just not to your specs, then balance how much you want this over with against how intolerable the mistakes are. But in the end, common sense tells me I do not think the seller can expect you to sign off on an unacceptable product, but without seeing the contract, I don't think anyone can be sure.

The house was manufactored with the bottom being finished and not the top. However, we sigmed a contact for the top to be finished in the package and that what the bank loaned us the money for. The money was being controled by the sellers and they supplied all of the contactors.

I was speaking with one of the contactor the other day and I heard him say that the seller needed to close on the house to generate some money and he would finish the top after closing. The grading, the well, the septic and the top is not finished.

The answer is in your contract. If you don't understand the contract get a real estate attorney involved. If your contract says that you don't have to pay for something until it is satisfactorily completed then don't pay for it until it is completed.
Sounds to me like the builder is having cash problems. If he's trying to get you to "finance his cash problems" by paying for something before your contract calls for it to be paid then it's "attorney time". Good Luck.

The contract I have is pretty clear and everything that the seller owes is satated on the WE OWE SHEET i.e. heat pump, grading, upstairs 4 bedrooms or completed and so on.
