I live Huntsville, AL. I’m actually suppose to close today on a new construction house. My problem is that back in early October, I made the sales agent aware of a brick issue (mortar joints were large and very inconsistent). Sales agent told me that the builder was already aware of the issue and would have it fixed.at my initial walk through the brick had not been fixed. It was put on the punch list last Monday to be fixed. On Friday sales agent said that the builder told her everything was ready for closing (which is today). Well, I rode by the house yesterday, it looks like they started to replace brick above the garage, but when they did, they used the completely wrong brick and then just left the rest bare with no brick. What in the world am I suppose to do??

Don't go to closing unless the house is complete. Would you buy a car with only three wheels? Would you buy a gallon jug of milk with only three quarts in it?

What does your contract say about punchlist items and closing? What does YOUR agent say?

Builder is going to pressure you like mad. Don't fall for it. Just hang up. "Call me when the house is complete and ready for final walk through". It is YOUR money.

Thank you for all the suggests. Contract says that an incomplete punch list cannot delay closing. My agent has already called the sales agent asking to push back closing until the house is ready. We haven’t heard back from the sales agent yet. This is my first new construction house, so I’m not entirely sure how the Certificate of a Occupancy works, but I couldn’t imagine that the signed off on the house with a whole sleeve of missing bricks on the front of the house.
I’m suppose to have the final walk through at noon and close at 2:00.

Agreed. Once you close you lose leverage to get them back out to fix it.

Sounds like this is bigger than "punch list" items. Punch list is touch up paint or a missing shelf in the closet.

Agree. Find out of they have a C of O. This is not a punchlist item. Once you close, you give up all your leverage.

People often buy car before they are even built, so not a great comparison.

Well, no, you ORDER the car.

You don't BUY the car till you take possession.

And you knew perfectly well what I meant, anyway. Are you suggesting OP ought to close on a house with major unfinished deficiencies, and on what grounds are you recommending that course of action?
