Then ask your realtor what will happen in this situation. We can't give you a good answer without reading your contract.

Curious, if you must close, then why risk losing a buyer and delaying your sale indefinitely? Will you just take it off the market?

Yes I am willing to lose a buyer because I see more problems with the lawyers as well. They do not contact me they contact my realtor and that is by e-mail. I feel that they should be contacting me because I am their client. This whole deal has been a nightmare.

Who is "they" your attorney? The buyer's attorney? The buyer? The buyer's agent?

Yes I will take it off the market until the market is better. But the thing is I don"t feel that anyone was working for our behalf. I have bought and sold 7 houses and never had a dealing like this one. The lawyers always contacted me not my realtor. By the way my realtor happens to be my son-in-law, mistake number one. He is new to this and I don"t want to cause waves for my family. But I don"t want to be taken advantage of. I need a lawyer who will work for me and not the buyer. First of all I was never told the lawyer recommended from my realtor was going to be out on maternity leave and the lawyer who reprsents the buyer was away from December and the secretary working for my lawyer while she is out just called his office today. Talk about lack of commumications. Well thank you anyway for your time . I do appreaciate it

They meaning my attorney working on this transaction. The firm is Pheterson Stern Calabrese Neilans & Spatorico. My lawyer working on this was supposed to be Lisa A. Neilans, but I have only got to talk to her secretary Ruth, don"t have a last name. The buyers lawyer is Walter Jones From Canandaigua. Who I have never spoke with. I was told my lawyer would take care of everything. Well you would think that when an attorney is going to be out that long , another attornery would be asigned. Thank you very much

I think that if you want to sell, now may be better than later.

Flexibility is what will get this done. I would give them an extension, talk to your agent/SIL about your expectations for a smooth, timely and completed transaction.

Call up Ruth, ask her for help. Tell her you appreciate all she has done for you.

Everyone knows that the staff gets things done, that is their job.

I agree with 2bindenver. Don't lose sight of getting it sold and likely at a better price now than later just because of some administrative issues.

I am in an area where it is customary for both parties to be represented by respective counsel. In almost every case, the lion's share of work and communication is handled by a paralegal or an assistant because most of the work is routine and the customary fees reflect this.

This is rarely explained up front to clients by the attorney.

It's a rare attorney's office that manages to keep all the right people in the loop, all the time.

I can appreciate your frustration. Having said this, you are almost at the finish line. Bite the bullet and get closed. In the big picture a few days is not going to matter, will it?
