Ok, I'd LOVE some input here from both realtors and sellers. We are coming to an end on our exclusive (June 30) ... we've had a seriously bad experience with this particular RE company. We definitely won't be resigning with them, actually my husband doesn't want to sign another exclusive at all with anyone. We were thinking of making up fliers and handing them out to all the RE Companies in our area offering 4% commission (or 3.5% with $1000 to the agent who sells it). Do you guys think that agents would show the house if we did this even though we won't be bound to a contract? This is what makes me nervous. We are in a popular area in NYC.
I'd hate to have another 3 months wasted if we did another exclusive and the house was not shown. Mind you, our agent showed the house to 4 people but we had more than 10x that amount banging on our door saying the company was not returning their calls and they wanted to see it.
I'd like opinions on this as I want my house shown as much as possible, I have no problem paying the commission but just want to sell!

Hi Sally, I think NY is an attorney state anyway (Realtors there please correct me if I read other threads incorrectly), but since you're willing to do the work/expense of marketing the house, offering good selling agency commissions no harm giving it a try IMO. Or interview several other brokerages that will actually earn it's keep; not all brokerages are like the one you previously dealt with. Sorry this one appears to have performed so bad that you all don't want to work with another, but if you want to try the flyers, good selling agency commissions - buyer agents just want to find the right home for their clients and when they do, receive compensation for their efforts in a transaction. You will though of course have to have an experienced RE attorney handle things once an offer is submitted, but . .. as a thought maybe before you go through the time, etc. of commencing marketing, interview other brokerages, ask a lot of questions about what they're going to do for you, what your expectations are and see if you find one that makes you both go 'now THIS is what I'm talking about!' Good luck!

We got an offer $10k below what we were willing to take but instead of our agent getting her to make the offer on paper and trying to counter she simply told her client that we would refuse and left it at that. This was in the first two weeks of listing. I don't think I will get over that.

Sally, don't just talk to one but many and remember: You are interviewing them, not the other way around. You indicate you really don't want the hassle of a FSBO and there are actually very competent brokerages and Realtors out there - you just need to find the one that fits YOU, will be responsive to your needs, be proactive marketing and do things like return phone calls from potential buyers/buyer agents.
Now onto what you posted here and let me get me make sure I read this correctly: You were signed exclusively with this brokerage and your agent did NOT even have the other agent put the offer in writing to present to you?????????? I don't know how NY Exclusive right to Sell contracts read but from where I come from that's one of the main responsibilities the brokerage has to a seller - to present any and all offers in a timely manner!!! It's the SELLERS call to either accept the offer, reject the offer or counter the offer! Not the agent telling the people making the offer, oh don't bother writing up an offer, my client's won't accept. I mean ????? If that happened, well, I would be considering doing more than just finding another brokerage. That, again if NY exclusive right to sell contracts are like others, is a major breach in their responsibility to you and very well cost you a sale IMO
Thanks c21. I was stunned that our agent didn't get it on paper, in the very least. We are moving to NC and we put an offer in on a house and our buyers agent wouldn't even speak to the listing agent till we had all kinds of stuff on paper.
Can I ask, if we decide that we won't be doing an exclusive, how do I make sure I can get it on the MLS? I know there is a fee involved but curious how that works. Is this only for realtors to see?

I never practiced on a limited agency or non-exclusive basis, but due to the fact you're moving to another state IMO you need a full service brokerage who can help you since this is relocation - a lot of things that will need to be coordinated between the 2 brokerages. I had a big relocation from Texas to Colorado and believe me when I say, it took real team work from both our brokerages to make it work. So, if you were staying in the area, etc. you could work some sort of flat fee/limited agency situation where you got MLS exposure, but you're relocating to another state so, again JMO, I think you need higher levels of service and representation.
