I have no intention on cheating anyone. We just did not appreciate the many lies we were told about what was really going on with the closing...We are out extra money from the delay.. .The reason for the delay seemed to change every other day. and most of what they told us was a pack of lies!

To put an even finer point on it, if the escrow agent called me and told me that the seller wasn't going to authorize my commission, I'd be at the courthouse the next morning filing a lis pendens which would cloud the title and delay the closing even further.

A seller is obligated to pay a commission if a real estate agency produces a ready, willing and able buyer during the term of the listing agreement. The listing contract expiration date, means that the seller is not obligated to pay a commission on any new potential buyer introduced to the property after that date.

How do you know they were lies as related from the agent?

I have, many times, called the lender to see what was going on and was told one thing. When I called a day later I was told something else.

How do you know it was not everything he told you?

It is very possible to have a title issue (lien or deed) and a government issue (lien or deed) be the same thing. The bank will also not set a closing until these are taken care of.

You, or most of you are real estate agents.and I appreciate all your comments.but,. you are not looking at this from a seller's prospective. We were told it would close in less then 45 days, more like 30 days.....I finally had to get a lawyer to find out what really was going on, since I wasn't getting any straight answers from my real estate agents.

He said it was held up by the buyer's lawyer.. but I was told by my real estate agents that it was held up by the government, by the bank not giving a closing date, by a deed, and then it was the state government.. never got a real answer.. anyway.. the house will be sold this week after waiting 4 months of getting the runaround..

And could it be that the buyer's lawyer was holding it up due to the issues your agent indicated? Did you find out why the buyer's lawyer held up closing?

There's no reason for your agent to want to delay closing since they don't get paid until it closes. Why would they intentionally lie about the cause of the delay?

He evidently didn't get off his butt and do the paperwork...Which was his fault.. I just didn't appreciate the different reasons that the real estate agents were giving me every other day.....They told me so many crazy stories .. then they didn't even realize that they were backtracking and making this whole affair a real mess..

Again, not trying to be difficult, but could your agent have been told this information 'by the buyer's attorney' who as you said didn't get off his butt and do the paperwork? I worked with attorneys for 15 years in the states and work with them down here. The old abagado (attorney) backpeddle isn't a new concept. Just thinking that maybe when the agent was following up they were relying on what the attorney was telling them. Like another poster pointed out, unlike attorneys who get paid hourly or flat rate 'regardless if the sale goes through or not', agents only get paid once the property closes, so . . .
