A couple of months ago I negotiated, through a broker, to buy a house. The deal didn't go through for reasons I won't get into. The house has since been removed from MLS, is not being advertised, and I assume the broker's contract has expired (it was advertised on MLS for six months).

Now that the house is not listed by the broker, can I contact the buyer directly? If I have to wait a certain period after contract expiration, how long is that period normally? I would only do this if the broker would not be due the fee. Would the fee be due anyway because I was showed the house originally by the broker?

Most brokerages have a hold over clause of 3-6 months.

Depends on the listing agreement.

My listings are 6 months.

I know of a few agents who do 12 months.

Ditto - this was put into effect by real estate commissions to prevent buyers and sellers from waiting out the expiration of a listing contract and bypassing brokerages.

I'm curious though, as you said the deal didn't go through when you negotiated 2 months ago through a broker, for reasons you don't want to go into, why you're not going through the broker now - just because it may or may not be listed, why wouldn't you want to use the broker who handled the initial negotiations to begin with?
